Effective from 14 October 2026
This is the English version of the Terms. In case of any discrepancy, the Polish version (“Regulamin”) prevails.
1. General
1.1. These Terms govern the use of the MedMigrant website at medmigrant.com and the MedMigrant mobile apps (together, the “Service”). They are the terms required by Article 8 of the Polish Act of 18 July 2002 on the provision of services by electronic means.
1.2. The Service is provided and operated by Prospect-Med Rafał Sójka, ul. Bagnowska 43, 15-189 Białystok, Poland, registered in the Polish Central Register and Information on Business Activity (CEIDG), tax ID (NIP) 966-215-04-01, REGON 389006478 (the “Provider”). Contact: prospect.med.ua@gmail.com.
1.3. “User” means an individual who uses the Service. “Account” means the User’s personal area in the Service protected by a login and password. “User Content” means comments and questions published by Users in the Service. “Consumer” means a User who is a consumer under the Polish Civil Code or the consumer law of their country of residence.
1.4. The Service is intended for people aged 18 or over. By creating an Account you confirm that you are an adult.
1.5. By using the Service you accept these Terms. By creating an Account you also confirm that you have read the Privacy Policy.
2. What the Service offers
2.1. The Service is a multiple-choice practice platform for people preparing for medical exams. It includes question banks for different countries, study mode and exam mode, progress statistics, personal notes, a clipboard of saved questions, comments on questions, and questions added by Users.
2.2. On the effective date of these Terms, all features of the Service are free. Section 10 explains how paid services would be introduced.
2.3. The Service is provided electronically on an ongoing basis under a contract concluded when you create an Account. The contract is for an indefinite period and either party may end it at any time (section 13). Parts of the Service can be browsed without an Account.
3. Nature of the materials
3.1. The materials in the Service are for educational purposes only. They are not medical advice or clinical guidelines and must not be used as a basis for treating any person.
3.2. Some questions come from publicly available sources and are presented for educational purposes, some are original questions written by the Provider, and some are tasks recalled from memory by people who took the exam. Recalled questions are not official exam material, may differ from the original and may contain errors. Correct answers and explanations may be incomplete or out of date. Always verify them against current textbooks and guidelines.
3.3. The Service is not affiliated with, and is not endorsed by, any body that organises state, licensing or professional exams. Names of exams, institutions and trademarks belong to their owners and are used only descriptively.
3.4. The Provider does not guarantee that using the Service will result in passing any exam or any particular score.
4. Technical requirements
You need a device with internet access, a current web browser with JavaScript and cookies enabled (or an Android phone for the app), and a working e-mail address if you create an Account.
5. Account
5.1. To create an Account you provide a login, e-mail address and password, and accept these Terms. The data must be true, and the e-mail address must be yours.
5.2. The Account is personal. Do not share it, keep your password confidential and tell the Provider immediately if you suspect it was taken over.
5.3. Your display name (by default your login) is publicly visible next to your comments and questions. Do not put in it anything you do not want to disclose.
5.4. You can change your Account details in your Profile and delete your Account at any time (section 13).
6. Rules of use
You must use the Service lawfully and in line with these Terms. In particular, you must not:
- automatically download or copy the question bank, answers or explanations (scraping), resell them, republish them elsewhere or share them with third parties in whole or in substantial part;
- circumvent the Service’s security, disrupt its operation or try to gain unauthorised access to other accounts or data;
- create multiple accounts to evade a block or the rules of the Service;
- publish content that breaches section 7.
7. User Content and community rules
7.1. You are responsible for what you publish. You must not publish content that:
- is unlawful, abusive, hateful, discriminatory, threatening or harassing, is sexually explicit or promotes violence;
- contains patients’ personal data or other information covered by professional secrecy. Never enter anything that could identify a patient, such as a name, national ID number, photographs or medical records;
- discloses other people’s personal data without their consent;
- is spam or advertising, links to paid courses or competing services, or is used to collect personal data;
- infringes copyright or other rights, including reproducing exam materials that you agreed to keep confidential;
- contains or links to malware;
- is misleading, in particular presents as fact medical information that you know to be untrue.
7.2. By publishing a comment or question you grant the Provider a free, non-exclusive licence to display it in the Service, including in the mobile apps, and to make necessary technical and editorial changes (such as fixing spelling, shortening or assigning a category), for as long as the content is available in the Service. You confirm that you have the right to publish it. Your moral rights remain with you.
7.3. The Service includes moderation tools:
- every User comment and question has a “Report” button where you can choose a reason;
- the “Block” button hides the selected User’s content from you. You can see and change your list of blocked Users in your Profile at any time;
- after several Users report an item, it is automatically hidden until the Provider has reviewed it. The final decision is always made by a person;
- the Provider may remove content that breaches these Terms, warn the User, restrict their ability to publish, or block or delete the Account. The decision depends on the seriousness of the breach and whether it is repeated. In serious cases (for example unlawful content, threats, patient data) an Account may be blocked without warning.
7.4. The Provider has no general obligation to review User Content in advance.
8. Reporting unlawful content and breaches of these Terms
8.1. Anyone, including people without an Account, can report content they consider unlawful or in breach of these Terms. Use the “Report” button next to the content or e-mail prospect.med.ua@gmail.com. In an e-mail report give the page address and a description of the content, explain why you think it is not allowed, and include your contact details. This address is also the single point of contact for Users and authorities under Regulation (EU) 2022/2065 (Digital Services Act). You can write in Polish or English.
8.2. The Provider reviews reports without undue delay, where possible within 3 working days, and tells the reporter the decision.
8.3. If the Provider removes or hides content, or restricts or blocks an Account, it will inform the User concerned by e-mail, giving the reason and how to appeal. An appeal can be sent by e-mail within 30 days. The Provider will consider it within 14 days and, where possible, by a person who did not make the original decision.
8.4. Rights holders. If you believe that content in the Service, including a question or explanation, infringes your rights or material that you must keep confidential, write to the address in section 8.1, identifying the content and the basis of your claim. The Provider will review the report and, if needed, promptly remove the content or disable access to it.
9. Rights in the Service
9.1. The Service, including its layout, code, marks and the Provider’s original content (original questions, explanations and compilations), is protected by copyright. All rights reserved.
9.2. The Provider grants you a non-exclusive, non-transferable licence to use the Service only for your own non-commercial study, for the duration of the contract.
10. Paid services
10.1. On the effective date of these Terms the Service offers no paid services and charges no fees.
10.2. The Provider may introduce paid features or premium access in the future. Before you enter into a contract for such a service, you will be given the price, scope, duration, payment method, the entity taking the payment, and the rules on withdrawal and complaints. These rules will be added to the Terms under section 15. Introducing fees will not make your Account or the free features you already use chargeable without your consent.
10.3. The “Shop” page in the Service (where visible) is informational and is not an offer to sell.
11. Mobile apps
11.1. The MedMigrant apps available on Google Play display the Service for the selected country. The Account and data are shared with the browser version.
11.2. Installing the app is also subject to Google Play’s terms. Google is not a party to the contract with the Provider and is not responsible for the Service.
11.3. The apps do not offer purchases or links to payments outside Google Play.
12. Liability
12.1. The Provider takes reasonable care that the Service works properly but does not guarantee uninterrupted access. It may temporarily suspend the Service for maintenance, failures or reasons beyond its control.
12.2. The Provider is not liable for decisions made on the basis of the educational materials, including exam results, or for content published by Users. Once it receives credible information that content is unlawful, the Provider promptly removes it or disables access to it.
12.3. Nothing in this section excludes or limits rights that Consumers have under mandatory law.
13. Deleting your Account and ending the contract
13.1. You can delete your Account at any time at medmigrant.com/delete-account/ (when logged in, confirming with your password) or by e-mail request. Deleting the Account also deletes your study data (answers, results, notes, clipboard, unfinished tests) and your comments and questions. The data may remain in the hosting provider’s backups for a limited time until they are rotated.
13.2. The Provider may terminate the contract, or block or delete an Account, for important reasons, in particular a serious or repeated breach of sections 6 and 7, after notifying the User unless this is prevented by security reasons or by law.
14. Complaints and disputes
14.1. Complaints about the Service can be sent by e-mail to prospect.med.ua@gmail.com. Please include your login, a description of the problem and what you expect. The Provider will reply within 14 days.
14.2. Consumers may use out-of-court dispute resolution, including contacting a consumer ombudsman or the Trade Inspection in Poland (information: uokik.gov.pl) or the consumer authority in their country of residence. Using them is voluntary.
14.3. For matters concerning personal data you may also lodge a complaint with a supervisory authority (details in the Privacy Policy).
15. Changes to the Terms
15.1. The Provider may change the Terms for important reasons, such as a change in law, a change in the scope or operation of the Service (including the introduction of paid services), security, or court or authority decisions.
15.2. The Provider will announce a change at least 14 days before it takes effect, in the Service and, for material changes, by e-mail to the Account address. If you do not accept the changes, you can delete your Account before they take effect. Continuing to use the Service after they take effect means you accept them.
16. Final provisions
16.1. Polish law governs contracts made through the Service. For Consumers this does not deprive them of the protection given by mandatory provisions of the law of their country of habitual residence.
16.2. Disputes with Users who are not Consumers are decided by the court competent for the Provider’s registered seat.
16.3. The Terms are available in the Service in Polish and English. In case of discrepancy, the Polish version prevails.
16.4. You can save, print or store the Terms using your browser.
